What will be the new law on customs clearance

After the round table, new rhetoric came from the new government:

  • in theory they will be able to possibly adopt a new law where there will be a flat tax rate depending on the year or car and the rate can start from 500 euros, but this option is unlikely
  • the second option is more realistic, according to the authorities, they can reduce taxes and most likely they want to amend law 8487 and it is there that either the excise tax itself or the age coefficient can be removed and then taxes will be from 33% to 35%

While we live according to the old law and who has euro plates from August 22, it is better to leave a car in the garage and wait for the law to be extended.

What is the reaction of the authorities to EUROBLES

1. BORDER SERVICE
They operate in a regular mode, without any changes for the pass of EURONOMERS.
2. CUSTOMS
Apply penalties, which are spelled out in law 8488, from UAH 8500 to UAH 170,000, but only to those who will cross the border, and without a difference, on expired cars or without it.

According to the additions to Art. 35 of the Law "On Police", the police received a reason to stop EUROBLES in order to check the legality of his stay.

However, due to the fact that until the customs and police bases are merged, such fines will not be imposed. The maximum is a stop, warnings, clarifications and wishes of a happy journey.
If the car is cleared by customs, but has not yet been registered (on transit numbers), they are fined 170 UAH. Everything else is speculation or illegal actions.
4. POSITION OF AUTHORITY
The President introduced urgent bill 10462 on the postponement of the said sanctions until November 22.
During this time, the Office of the President, together with the working group, should work out a law on customs clearance.

Customs clearance of cars Euro 4, Euro 3 and below.

In the Rada on November 8, 2018, they voted for the law on customs clearance of eurobills, 250 deputies said yes to the new, but rather controversial, customs clearance of cars with foreign registration. And as the months of new customs clearance showed, this law did not solve the problem of customs clearance for Eurobills, since after the end of the grace period in customs clearance, Eurobills hung for a long pause, except for 10 volunteers per month who, in despair, are clearing their Eurobills at space rates.
This is not to say that taxes on euro plates are adequate, since on a car the cost of 1000 euros of taxes even in the transitional period (90 days) you had to pay at least 1500 euros, and if you have a large engine volume (from 3.5 diesel and from 3 liters gasoline), then taxes will definitely be too heavy.

Excise duty is calculated in euro plates according to the coefficients.

According to bill 8487, there are several basic factors.
In the first 90 days, the so-called transition period, there was a 50% discount only on excise duty one of the three taxes, the next 90 days there will be no discount.
We also have coefficients:

  • excise duty price coefficient for diesel 75 euros for engines up to 3500 cubic meters. cm and more, which is 150 euros, and for gasoline up to 3000 cc. - 50 euros, more than 3000 cc - 100 euro,
  • car age coefficient (measured in years),
  • engine displacement (measured in liters),
  • it is also possible that there will be a special coefficient for cars over 15 years old in the amount of the base rate of 15.

Example of calculating excise duty only.
Petrol:
We multiply 50 euros by the age of the car 10 years old and by the volume of 1.6 = 800 euros of excise tax.
Diesel:
We multiply 75 euros by the age of the car 10 years and by the volume of 1.6 = 1200 euros of excise tax.
As we wrote, in addition to the excise tax, there is also a duty and VAT, and now let's calculate the entire amount of taxes on a car.
For example, a car with a 1.6 diesel engine, which is 10 years old and costs 3,000 euros, will be calculated using the following formula:
➡ 10% duty - from 3000 euros = 300 euros
➡ excise tax 75 multiplied by 10 years and multiplied by 1, 6 = 1200 (50% discount - 600 euros in the first 90 days)
➡ VAT (3000 + 300 + 1200)% 20 = 900 euros
Total taxes - 2,400 euros.
If we apply a 50% discount on excise tax, then taxes will be 1680 EURO.

According to the new formula for cars over 15 years old, we will get not very interesting figures, since the coefficients were left at the same level and only if the car is older than 15, the coefficient remains the same, everything is also 15. For example, we calculate a car with the following parameters: 2000 with volume 2.0 diesel and cost 1000 euros.
➡ 10% duty - from 1000 euros = 100 euros
➡ excise of the base rate 75 multiplied by 2 and the base rate for age 15 = 2250 euros (50% discount - 1125 euros in the first 90 days)
➡ VAT (1000 + 100 +2250)% 20 = 670 euros
Total taxes - 3188 euros.
If we apply a 50% discount on excise tax, then taxes will be 1670 EURO.
And this is the foundation for the basic rates (50, 75 euros) of excise tax under the law of Eurobels. This is just a mockery of common sense, the longer the problem with euro plates is not solved, the more difficult our ecology will be. Changes that were rejected by voting in the Verkhovna Rada of 11/08/18

  • extension of the proposed new excise tax model to all vehicles;
  • narrowing the VAT tax base for goods that are introduced by excluding duties and excise from the price of the goods (important: excise and duty will not be removed as a tax, they will simply be removed from the VAT deduction base, which will not greatly reduce space tax rates);
  • VAT exemption for vehicles imported new and used until 2019 (inclusive), except for vehicles originating from a country recognized by the occupying state, as well as those that have been produced for more than 10 years at the time of import;
  • abolition of excise duty on trucks, bodies and motorcycles;
  • application of a 50% excise tax discount for combatants (YUZHANINA ARGUMENTED THIS TO THAT THERE IS A POWER OF ATTORNEY IN UKRAINE AND THEREFORE WILL NOT CONTROL WHO IS THE REAL OWNER OF THESE CARS);
  • replacement of the age coefficient with the ECO coefficient, that is, the conformity of the car with the European environmental standard and establishing it in absolute values;
  • application to the age coefficient when calculating a reduction coefficient of 0.7 or even excluding it from the formula;
  • continuation until 2020 (inclusive) VAT exemption for vehicles equipped with electric motors;
  • taxation of hybrid vehicles at the excise rate for electric vehicles.

Now we can move from good news to bad news, namely, to fines for the delayed stay of a car at a foreign registration in Ukraine.

What will be the control and new fines under the law on customs clearance of cars 8488?

Now, a non-resident will be able to relatively freely bring in only one euroblack, and the second only after paying a financial guarantee. The amount of the guarantee must be equal to the amount of customs payments for the car.
Also, a person who brought a car to Ukraine in transit or temporary import mode cannot disassemble or give the car for commercial use. For example, if the police record the use of a non-cleared car in a taxi, then the violator will be fined UAH 8,500, and if the violation is re-recorded, the fine will be UAH 170,000. and deprivation of rights for a year, as well as confiscation of a car at the expense of the offender.

If in 2017 the volume of the used car market amounted to about 3 trillion rubles, then the expected potential tax revenues will amount to 20 billion rubles per year. Among the pluses: the transition of a significant volume of sales of used cars from a shadow zone to a transparent one, an improvement in the environmental situation due to control over the technical condition of the cars sold, a decrease in the number of accidents and fatal accidents due to control of the level of safety of equipment.

Deal without the right to choose

The Ministry of Industry and Trade told reporters that while there is no final version of the bill, the general scheme of the auto auction industry is being worked out. Officials want to oblige citizens to use a special electronic auction platform (or several such platforms), through which the sale of cars to dealers will take place. After that, anyone can buy a used car only from a dealer. There will be no direct transactions between owners and buyers.

True, officials are confident that they are on guard for the interests of citizens, and not only want to make money on a used car. Among the advantages, in particular, are named:

Back to the past or the Japanese experience

It turns out that the idea of ​​officials was pushed by Japan. In March, Deputy Minister of Industry and Trade Alexander Morozov, together with a Russian delegation, visited the Land of the Rising Sun, where he got acquainted with the experience of organizing car auctions. As a result, the parties agreed on further cooperation with the aim of "further borrowing the best foreign practices in this area."

In Japan, you can sell a used car only through a special auction. The owner of the car has the right to establish at the beginning of the auction the price limit corresponding to the market price. But trading starts with a minimum amount. The car can only be purchased by Japanese dealers who have paid the annual auction fee. Dealers raise the price until one of them wins. If the owner does not like the price, he has the right to refuse the deal.

It is noteworthy that this system is also not new to Russia. In the USSR, cars were bought and sold through specialized second-hand shops, which also acted as intermediaries. Without a certificate from such a store, the car could not be registered. Enterprising merchants set up a real business on this. Since the clearance through the store took a long time and only a certain number of transactions were allowed per day, certificates were simply sold. The cost was calculated as a percentage of the price of the car and was quite substantial.

Experts note that state regulation of the secondary car market is long overdue, but it is necessary to create transparent conditions for all parties. And also to develop such a mechanism that will give citizens the right to choose and will not significantly affect the cost of cars.

On the official Internet portal of legal information on September 26, 2018, the final version of Order No. 399 of the Ministry of Internal Affairs was published "On approval of the Rules for state registration of motor vehicles and trailers to them in the State Security Inspectorate road traffic…» , which replaces the registration rules approved by order no. 1001 ten years ago.

The officials decided to simplify the purchase and sale procedure for motorists by reducing bureaucratic delays. Now, when selling a car, it is not necessary to deregister it, which is an undoubted advantage for the seller... But at the same time, the risks of the buyer increase, who can discover some problems with the car only at the moment when he puts it on record with the nearest traffic police, which means that the property is already his property, and these problems cannot be avoided. According to a simplified scheme for selling a car, all actions with registration are performed only by the buyer(and he now has 10 whole days for this) - the seller has absolutely nothing to do with it. The seller's business is only to find this buyer, make a deal with him, get money and hand over documents and keys. The rest of the actions fall on the shoulders of the acquiring side. Thus, when selling a car, it is no longer required to deregister it, it is only necessary to conclude a legally competent agreement on its sale.

The car sale and purchase agreement is the most important legal document that defines the relationship between the seller and the buyer regarding the vehicle, and on the basis of which the ownership is transferred from one owner to another. Many people use outdated contract forms, while according to the new rules, its form should be slightly changed. If you use old forms, you can draw up a contract incorrectly, then it simply loses its legal force, and this is fraught with troubles and problems for both the buyer and the seller.

The agreement is drawn up between the parties in a simple written / printed form, in duplicate. Neither a notary, nor anywhere else, does not need to certify such a document.

The contract for the sale of a car under the new rules specifies:

  • The locality where the contract is drawn up, the date of its drawing up.
  • Data of the parties, their passport data, registration data.
  • Subject of purchase and sale: the car itself, where it is indicated full specifications, according to the vehicle passport (model name, engine, body and chassis numbers, color, year of manufacture, l / s, kW, carrying capacity, etc.)
  • Vehicle identification numbers and passport data.
  • Full cost car, it is indicated in numbers and words.
  • The state number and data of the car registration certificate can be entered as a separate clause in the contract at the request of the seller or the buyer, but are not mandatory. Requirement in mandatory it is not legal to indicate these data in the contract by the traffic police inspectors who process the re-registration of the vehicle.

When drawing up a contract, it is important to be guided by the principle of completeness of information; it must be exhaustive and not allowing any interpretation.

Most often, they leave the form as it is, just fill in the necessary lines. But you can download the form in a format where there is editing, and add certain important and significant points. As a rule, one of the parties will arrange the forms. As a tip: having downloaded the form, it is best to fill it out immediately, on a computer, and completely - on one side and on the other. Different filling of the contract is not allowed, it can be filled in:

  • On a computer (fully printed).
  • By hand (filling in the data in the left lines with a ballpoint, capillary blue pen, filling in a color other than blue (for example, black, red) is not allowed).

You need to fill out the document either in the first or second way. That is, you cannot, for example, print the data of one side on a computer, bring it to the other side, and she, in turn, will fill in her data by hand. It shouldn't be like that. It is best to make the agreement in full in printed form, where only the signatures will be affixed with a pen. If the lines of the agreement are filled in by hand, then it is necessary to start writing from the very beginning of the line, and put a dash at the end in order to exclude any "additions" by unscrupulous parties. Also, when filling out a document with a pen, no blots and "clerical errors" are allowed.

We draw up an act of acceptance and transfer of the vehicle

It is also recommended to draw up an act of acceptance and transfer of the car between the parties, where the data of the seller (transmitting party) and the buyer (receiving party), vehicle identification data are duplicated, and the place ( locality) and date of transmission. It is also important to indicate in the act the fact of transfer of documents for the car and keys from it to the buyer. Both parties sign this act, in duplicate, for the seller it is a confirmation document that he really transferred the property along with the keys and documents, and did not just take money for the car. This action will protect the seller in the event of unreasonable claims being presented to him.

Of course, you can do without the act of transferring the object of sale. But then such clauses should be entered into the purchase and sale agreement itself, where lines like "the car handed over" and "the car took over" will appear separately. It is also advisable to include a clause stating that new owner received a set of keys and documents. There are enough fraudsters on the part of buyers, so it is better to secure yourself with such clauses in the contract, or with a separate act. Ideally, you can also invite witnesses to the transfer of the car, who are not interested in this transaction.

You should take care of the sale and the TCP. Taking care of the compliance of this document with the rules falls entirely on the shoulders of the seller, as on the actual owner of the car. The most important thing before the direct sale and conclusion of the contract is to make sure that there is enough space in the vehicle's passport to make another entry indicating a change in the owner of the car. If there is no place, and, therefore, it will be impossible to make this entry, then the traffic police will refuse to re-register the car to a new person. Only the owner can make a new passport for the car, and the previous owner is the owner before re-registration, even if a sale agreement is signed and the object is directly transferred to the new owner. If the traffic police refuse to register the buyer who purchased the property, the latter will still be forced to contact the seller to make a new title. So these problems cannot be avoided. Therefore, the place in the vehicle passport should be taken care of in advance. If not, apply for a new one. If there is, then there is nothing to worry about.

If the seller or buyer is a third party

There are also some special cases of buying and selling a car. These are cases where the buyer or seller is only a third party in the transaction. That is, either one or the other (and maybe both) are acting on behalf of someone else.

The buyer, who subsequently will not be the owner of the car, should also acquire a power of attorney from the future owner, on whose behalf he acts. And some dealers for 5-10% of the cost of the car will also deal with the registration of all documents at the customs and in the service centers of the traffic police.

If you are going to search for, drive and register a car on your own, then you will need money to stay abroad for several days while you choose a car.
