1. GENERAL REQUIREMENTS OF LABOR PROTECTION

1.5. The driver of the PBX should take:

1.6. The driver of the PBX is required:

1.11. The PBX driver must be provided with personal protective equipment in accordance with the existing standards for the issuance of special clothing, special shoes and other personal protective equipment (PPE), developed on the basis of inter-sectoral rules for providing employees with special clothing, special shoes and other personal protective equipment.

1.17. 2. Requirements for labor protection before work

3.26. Requirements for labor protection during the operation of ATS operating on gas fuel.

The nuances associated with the specifics of driving work is reflected in the Regulations on the peculiarities of the working time and recreation time of car drivers, app. By order of the Ministry of Transport of the Russian Federation of 20.08.2004 No. 15. This document applies to drivers working in organizations of all forms of ownership, except those who carry out international transport or works as part of the Watch Brigades. Features of the working time and recreation time provided by the Regulation are necessarily taken into account in the preparation of work schedules (replacement) drivers.

Work schedules (replacement) on the line are compiled by the employer for all drivers every month for every day (shift) with daily or summarized working hours and brought to the attention of drivers no later than one month before their introduction. The chart indicates the start time, end and duration of daily work (shift), time breaks for recreation and nutrition, daily (intransman) time and weekly rest. The schedule of work (replacement) is approved by the employer, taking into account the opinion of the representative body of workers.

The normal duration of the working time drivers cannot exceed 40 hours a week. In cases where, under the terms of production (work), the established normal daily or weekly working time duration cannot be met, drivers are set by the summable accounting of working time with the duration of the account of one month. Duration of working time for the accounting period should not exceed the normal number of working hours.

With a summary working time accounting, the duration of the driver's change cannot exceed 10 hours (except for certain cases).

Drivers of passenger cars (except for a taxi) can be installed a non-corrugated working day (taking into account the opinion of the representative body of employees of the organization). The number and duration of workers shifts on work schedules (changeability) with an abnormal working day are established on the basis of the normal duration of the working week, and the days of weekly recreation are provided on the general reasons.

The car control time cannot exceed 9 (in some cases - 8) hours per day, and with summarized accounting of working time can be increased to 10 hours, but no more than two times a week. At the same time, the total duration of the car control in two weeks in a row can not exceed 90 hours.

During the driver's working hours, other periods, in particular, the pre-trial and post-tracking medical examinations, parking time at the loading and unloading points, the time of work on the elimination of faults and some others are also included. Included in the working time, the above periods can not be in full: for example, the time of cargo and the car is counted during the working time in the amount of at least 30%, the presence time at the driver's workplace, when it does not control the car, when directed by two drivers - In the amount of at least 50%.

In cases provided for by Art. 99 TC RF, drivers can be involved in the performance of overtime, but they should not exceed four hours within two days in a row and 120 hours per year.

Is it possible to send the driver on a business trip?

In accordance with Art. 57 of the Labor Code of the Russian Federation, the indication of the nature of the work should contain an employment contract with the employee. Service trips of workers, the permanent work of which is carried out in the way or has a traveling character, are not recognized by official business trips (part 1). The driver's work is traveling in nature (if the driver has the ability to return to his place of residence daily) or is carried out on the way (if there is no such possibility), so the service trips of these employees are not business trips. In accordance with Art. 168.1 TC RF drivers should reimburse expenses associated with official trips, such as:

expenses for travel;

costs of hiring residential premises;

additional costs associated with accommodation outside the place of permanent residence (daily, field satisfaction);

other expenses made by employees with permission or knowledge of the employer.

The procedure for reimbursement of expenses is established in a collective agreement, agreement, a local regulatory act (for example, in a position on the traveling nature of the work). Restrictions on part-time work

It is impossible to make a driver of part-time persons who perform similar functions at the main place of work (vehicle management or their movement). Full material responsibility is assigned to the driver in situations provided for by Art. 243 TK RF, in particular, in the following cases:

Damage is the right, not the obligation of the employer; It can fully or partially release the employee from its reimbursement (Art. 240 of the Labor Code of the Russian Federation). If the amount of damage does not exceed the average monthly earnings, it can be recovered by the written order of the employer (Article 241, Part 1 of Art. 248 of the Labor Code of the Russian Federation). If the amount of damage exceeds the average monthly earnings, it can be reimbursed either by an employee voluntarily or by the court decision (Part 2 and 4 of Art. 248 of the Labor Code of the Russian Federation). Does the driver's consent required to change the car?

If there are no references to a particular car in the labor contract, then in order to transplant the driver to another car, it does not require agreement (paragraph 3 of Art. 72.1 of the Labor Code of the Russian Federation).

What to do if the driver cannot fulfill his duties as a driver?

If an employee in accordance with his medical conclusion issued to him needs to be transferred to another job, the employer is obliged to provide such work with the written consent of the employee (Article 73 of the Labor Code of the Russian Federation). In practice, for this, the employer sends a notice to the driver, which indicates the vacancies they have (both vacancies or work, relevant employee qualifications and vacancies or lower jobs) or reported their absence. Offering vacancies in other localities, the employer is obliged if it is provided for by the collective agreement, agreements, an employment contract (part 2 of Art. 83 of the Labor Code of the Russian Federation). In this notice, the employee must make a written mark and report on his consent or disagreement to carry out work on one of the proposed posts. If the employee agrees to transfer, the parties conclude an additional agreement to the employment contract for the transfer for the term specified in medical conclusion. If the suitable vacancies have no employer, or the employee does not agree to the translation, then the further actions of the employer depends on the period on which the employee in accordance with the medical conclusion should be translated.

If the translation is necessary for a period of up to four months, then in the absence of vacant posts or in the event of a refusal of an employee from the vacancies proposed by him, the head must remove it from work for the entire period specified in medical conclusion. In this case, the employee's salary is not accrued (part 2 of Art. 73 of the Labor Code of the Russian Federation).

If the employee needs to be transferred for a period of more than four months or constantly, but there are no suitable vacancies from the employer, or the employee refuses them, the employment contract is terminated on the basis of paragraph 8 of Part 1 of Art. 77 TC RF with the wording "in connection with the refusal to transfer to another work in accordance with the medical conclusion." When dismissal on this basis, the employee pays a day off manual in the amount of a two-week average earnings (paragraph 1 of Part 3 of Art. 178 of the Labor Code of the Russian Federation).

How to do if the driver was deprived of rights?

Professional activity of the driver is possible if he has special rights, which is confirmed by a driver's license issued by the traffic police. Only in the presence of such a driver has the right to control the vehicle (clause 4 of article 25 of the Law No. 196-FZ). According to Part 1 of Art. 28 of the same law, the effect of this right is terminated if:

the term of the driver's license has expired;

If the rights are seized for up to two months, the actions of the employer are determined by the provisions of Art. 76 TK RF: The driver must be transferred to work that is not related to the management of the vehicle, or is removed from work for the entire deprivation of special law. In practice, the employer should send a notice to the employee in which you need to specify the vacancies you have or reported. The worker, in turn, should report his agreement or disagreement to carry out work on one of the proposed posts. If the employee agrees for the translation, the parties conclude an additional agreement to the employment contract. Information on temporary translation into the labor book is not made. If the appropriate vacancies have no employer, or the employee does not agree to the translation, then it is necessary to publish an order to remove from work for the entire period of suspension of special law. In the period of removal from work, the employee is not accrued, also this period is not included in the work experience, giving the right to the annual leave (Article 76 and 121 of the Labor Code of the Russian Federation).

If the rights are seized for a period of more than two months, then the actions of the employer are determined by the provisions: the driver must be transferred to work that is not related to the management of the vehicle, and if it is impossible - the employment contract is terminated with it. If he agrees to translate, the parties conclude an additional agreement to the employment contract, and the employer makes an order of translating. If there are no suitable vacancies from the employer, or the employee refuses to translate, the employment contract is terminated on the basis of paragraph 9 of Part 1 of Art. 83 of the Labor Code of the Russian Federation - in connection with the deprivation of a special law employee (on the management of the vehicle), entailing the impossibility of fulfilling the employee responsibilities for the employment contract.
